Przedstawiono aspekty prawne prywatyzacji przedsiębiorstw komunalnych (dochodowych i użyteczności publicznej), oraz sporne problemy z tym związane.

The initial part of the paper deals with general problems of municipal enterprises commercialization that arise in connection with the choice of the legal and organizational form of their economic activities. Next, the procedural assumptions of the privatization and convertion of municipal enterprises are presented. Special regard is paid to the role of the municipal bodies. The possibility of founding workers'companies in order to manage the municipal property is discussed. Then, the competence of the municipal bodies as regards the selection of legal and organizational forms of the studied enterprises are outlined as well as the factual and legal circumstances of the conversion of a municipal enterprise into a budgetary undertaking are presented. The paper ends with conclusions. (original abstract)
