Abstrakty
Transformacja ustrojowa przełomu lat 1989/90 spowodowała, zdaniem autora, powstanie i wzrost nowego rodzaju przestępczości gospodarczej. Autor omówił ustawę o ochronie obrotu gospodarczego z 1994 r., jako głównego aktu prawnego, mającego zapewnić bezpieczeństwo reform gospodarczych, oraz niektóre przepisy prawa karnego dotyczące obrotu gospodarczego.
The article concerns the binding punitive regulations, as regards the economic activity carried out by individuals. The author discusses in detail the act of October 12 1994 on the protection of economic turnover and on amendment of certain regulations of punitive law (The Law Gazette No. 126, item 615) as well as other punitive regulations in force. The subject of the author's considerations is a detailed classification of offences included in the binding regulations, the principle of liability to criminal proceedings resulting from these regulations and the existing gaps in the regulations. The author is of the opinion that the act on protection of economic turnover should be amended. The act should contain a clause obliging courts dealing with certain offences mentioned in the act to impose (when passing a condemning judgement) an additional penalty i.e. a ban to carry out an economic activity or to hold the posts connected with representing economic entities.(original abstract)
