Autor przedstawił kilka sposobów łagodzenia błędnych decyzji gospodarczych osoby fizycznej prowadzącej działalność gospodarczą. Są to ugoda sądowa i pozasądowa, postępowanie pojednawcze i układowe. Omówił także zagadnienie upadłości i układu w postępowaniu upadłościowym, jako rozwiązania o charakterze ostatecznym, ale zarazem dającym możliwość działania gospodarczego.
The article presents a general characteristics of the situations when an economic entity - an individual is threatened by bankruptcy. It also discusses ways to prevent bankruptcy in the light of the current legal regulations. The author reviews different ways to prevent a loss of legal identity of an economic entity such as: the institution of agreement, court agreement, procedure of conciliation, compromise aimed proceedings and bankruptcy proceedings along with an agreement between the bankrupt and non-priviledged creditors. Following his considerations the author formulates a thesis that in the Polish law there exist many ways to mollify wrong economic decisions made by an individual - an economic entity. The regulations take into account justifield interests of creditors without providing solutions favouring only debtors, thus combining to the maximum the interests of creditors and debtors which are both contradictory and common.(original abstract)
