Abstrakty
Omówiono przepisy karne ustawy ubezpieczeniowej, ustawy o ochronie obrotu gospodarczego i przepisy karne kodeksu handlowego chroniące interesy ubezpieczonych.
Until now the interests of the insured (consumers of insurance services) have not been properly and sufficiently protected which is proved by the already numerous bankruptcies of insurance companies and the legal situation of the insured connected with this. The author characterises possible threats, indicates acts (behaviours) also of criminal character leading to unfavourable situation of the consumers of insurance services. Moreover, he characterises legal-punitive measures of protecting the insured, taking into account the changes introduced by a new codification of penal regulations from 1997. Analysing legal-punitive protection, the author puts forward de lege ferenda postulates the aim of which is to improve the situation and increase the effectiveness the already existing penal regulations. At the same time the author underlines the necessity to study the areas and behaviours which require adequate legal regulations and penalization. (original abstract)
