Anti-monopolistic law is an element of the system of instruments protecting a consumer on the market. The law does not make use of its instruments in all cases which are formally regarded as monopolistic practices, but only in those where a given monopolistic practice violates any entity subject to protection defined in the act. An essence of monopolistic practices is restriction of independence of consumers by an economic entity, a group of such entities or an association of economic entities which forces consumers' participation in business dealings on less favourable conditions than those under free competion, connected with unlawful abuse market power guaranteed by their position on the market. It is important to distinguish correctly between a monopolistic practice and unfair competition. The regulations are applied differently in both cases: unfair competition requires legal action and monopolistic practices - administrative procedure. (original abstract)
