Omówiono prawne rozwiązania zabezpieczenia roszczeń klientów banków i instytucji ubezpieczeniowych, które znalazły się w stanie upadłości. Realizację tych roszczeń mają zapewnić w takiej sytuacji dwie instytucje: Bankowy Fundusz Gwarancyjny i Ubezpieczeniowy Fundusz Gwarancyjny. Omówiono szczegółowo ich zadania.
In order to improve safety of transactions and confidence in banks and insurance companies, the legislator decided to create separate funds - institutions of legal personality. These are Bank Guarantee Fund and Insurance Guarantee Fund. The article presents the range of protection guaranteed by these funds to clients of banks or insurance companies. The role of these institutions becomes clearly visible when professional entities which are a party to an agreement with a customer have found themselves in the state of bankrupcy. The first part of the article deals with legal regulations concerning the Bank Guarantee Fund. The author presents subject and range of the protection of deposits placed by a bank`s clients and the mode of claiming procedure. Moreover, there are presented fundamental EU requirements which the Polish legislature must fulfil as regards bank deposits guarantees. The second institution discussed is Insurance Guarantee Fund which operates on two planes. Firstly, it preforms a protective function in relation on the harmed people, ensuring (within a strictly defined range) the payment of damages when the culprit has not been identified or has not been insured. Secondly, this fund guarantees the payment of damages in case an insurance company goes bankrupt. The latter of these functions is the subject of thise article. (original abstract)
