Abstrakty

Przedmiotem artykułu jest odpowiedzialność przewoźnika morskiego za szkody w ładunkach. Przedstawiono historię i przebieg regulacji, dotyczących umowy przewozu towarów morzem oraz zasad odpowiedzialności przewoźnika, ze szczególnym uwzględnieniem Reguł Hasko-Visbijskich i Reguł Hamburskich.

The development of international transport relations creates the necessity of unification of the rules of international transport law and harmonization of the legal solutions applied in particular branches of transport, especialy of maritime law. The International Convention of the Unification of Certain Rules of Law Relating to Bills of Lading (adopted in 1924 in Brussels) and generally refered to as the Hague Rules and the Brussels Protocol (Visby Rules) or 1968 have not fully attaired neither of these targets at any rate in a todays perspective. The regime created by Hague-Visby Rules does not seem to be as perfects as it is sometimes supposed to be. Hence, it is understandable that there has been an attempt to revise this system. As the result, on 31 March 1978 the UN Conference held in Hamburg adopted the UN-Convention on the carriage of goods by sea 1978 (Hamburg Rules). It entered into force in 1992 after 20 ratifications. This Convention reflected the opinion of the great majority of States of the world, including the decision on a change towards wider liability of the carrier. This is not only favoured by the developonig countries but by many industrialized countries as well, especially United States. The Hamburg Rules certainly are better and more modern convention from the view point of a lawyer but its economic impact should not be forgotten as well.(original abstract)
