Omówiono zagadnienie zbywania rzeczy ruchomej przez nieuprawnionego przedsiębiorcę drugiej stronie, którą również jest przedsiębiorca. Przedstawiono przedmiot nabycia na podstawie art. 169 k.c., podmioty czynności prawnych wg przepisu art. 169 k.c., przesłanki nabycia własności rzeczy ruchomej od osoby nieuprawnionej do rozporządzania, skutki nabycia własności rzeczy ruchomej od nieuprawnionego.

The paper presents issues related to acquisition by force of Art. 169 of the Civil Code, general issues related to the subjects of legal actions as stated in Art. 169 of the Civil Code, as well as the preconditions and effects of acquiring property from unlawful holders. Based in this general discussion, the author proceeded to elaborate on the specific legal standing of a business in reference to the subject matter, including the issues of settlement, recognition, the motion to cancel out mutual debt in a lawsuit, and the legal standing of a business (seller and buyer) after opening a settlement proceeding and declaring bankruptcy.(short original abstract)
