W reklamie porównawczej nadawca powołuje się na inne przedsiębiorstwa lub towary w celu wykorzystania dla siebie osiągnięć swych konkurentów albo podważenia ich. Aktualnie polskie ustawodawstwo nie dopuszcza możliwości stosowania reklamy porównawczej w wyniku obowiązywania ustawy z dn. 16 kwietnia 1993 r. O zwalczaniu nieuczciwej konkurencji. W wyniku zmian w prawodawstwie krajów UE, polegających na dopuszczaniu stosowania reklamy porównawczej, Polska będzie zmuszona dostosować swoje przepisy do obowiązujących w Unii. W artykule przedyskutowano rodzaje reklamy porównawczej oraz różnice pomiędzy reklamą porównawczą i nieuczciwą reklamą.
One of the most visible symptoms of market rivalry between enterprises is their use of advertising, and the competitive position of an enterprise is often achieved with the help of comparative advertising. In this type of advertisement, the advertiser makes reference to other enterprises or products, in order to gain advantage from the achievements of his competitor, or to undermine those achievements. Currently Polish legislation does not allow comparative advertising, but in the context of our drive to join the European Union, the laws will soon have to change; Poland has until 2002 to adapt her legislation in this area. The author discusses various types of comparative advertisements, and highlights the difference between a comparative advertisement, and a false advertisement. (original abstract)
