Abstrakty

Przedmiotem zainteresowania autorki jest zakres samodzielności dochodowej i wydatkowej gminy w związku z gospodarowaniem nieruchomościami komunalnymi. W tym celu zbadała kompetencje gminy odnośnie do wpływania na wielkość dochodów związanych z nieruchomościami oraz uprawnienia związane z ponoszeniem wydatków dotyczących gospodarowania nieruchomościami, według stanu prawnego na dzień 31 grudnia 1999 roku. W artykule przedstawiła pojęcie i podmioty mienia komunalnego, sposoby nabywania nieruchomości i gospodarowania nieruchomościami komunalnymi oraz kwestie dotyczące prowadzenia przez gminę działalności gospodarczej. Omówiła dochody budżetowe gminy z obrotu nieruchomościami oraz wydatki ponoszone przez gminę w związku z nieruchomościami komunalnymi.

The article concerns independence of communal self-government as regards the communal real estate management. This is a very important problem as the communal property is one of the economic basis ensuring independence of communes. Moreover, the related decisions are directly connected with the incomes and expenditures of the commune. The aim of the article is to present the range of both aspects of financial independence - incomes and expenditures - of the commune connected with the communal real estate management. The author studied competence of the commune as regards its influence on the volume of incomes from real estate and the rights connected with the expenditures resulting from the real estate management according to the legal status for 31 December 1999. The considerations indicate the commune coucils have no absolute freedom as regards their real estate management. Limited independence is particularly visible when related to incomes from the property owned. The rights of the communes are actually limited to lowering the prices and charges connected with real estate management. (original abstract)
