Autorka omówiła fundamentalne podstawy prawne władzy sądowniczej, zagwarantowane w Konstytucji Republiki Białoruś z 15 marca 1994 roku. Rozważania, w pierwszej kolejności dotyczyły konstytucyjnych podstaw władzy sądowniczej (m.in. wyłączności, niezawisłości, praworządności, jawności), a dalej struktury systemu sądowego Republiki Białoruś (sądy powszechne, gospodarcze i szczególne).

This paper is concerned with the problem of the judiciary authority in the light of the 1994 Constitution of the Belarussian Republic. The changes brought in the Republic by the Constitution are a successive stage of the judicial reform begun in 1992. The Belarussian judicature is based on generally recognised regulations of international law, as well as on native historical experience and the progressive achievements of other countries. It ensures the protection of civil rights, liberties and legal interests. The 1995 law on the judicature and the status of judges in the Belarussian Republic has further expanded the constitutional principles. The term 'judiciary authority' appeared in Belarus for the first time after 1917 when it ceased to be applied. At present the judiciary authority is the system of independent courts of law. The paper discusses the organisational principles of the judicature: those of exlusiveness, independence, legality, combination of collegiality and single-judge rule, open proceedings, participation of the intrested parties, the binding character of legal decisions, appeal aginst decisions, appointment of judges, appolitical impartiality of judges, the right to being tried in a court of law, presumption of innocence, and the right to legal assistance. Whitin the judicature there are common courts of law, economic courts and courts of special jurisdiction. (original abstract)
