Abstrakty
Przedmiotem rozważań autora są różne teorie stanowiące fundament teorii prawa naturalnego: realizm w rozumieniu prawa natury, nowy realizm prawa, stanowisko nominalistyczne i koncepcja ostateczenej racji prawa. Odrębnym problemem w artykule są zasady demokracji i kwestia prawa w społeczeństwie demokratycznym.
Man has a tendency to structure and categorise the reality around him. This frequently leads to absolutising a certain state, or order, which is exemplified by the problem of natural law. There are diferent standpoints concerning natural law. They can be reduced to realistic and nominalistic. An interesting from of the realism of law is Kant's conception that asserts that the laws of nature are aprioristic laws of the state that acquire a real content in concrete human union. A novel thesis was formulated here that the principle of law a formal character and it acquires greater and greater fulfilment in human action (this view was shared inter alia by Fichte and Hegel). An original conception of the law of nature was thus produced as a "sui generis" ideal that inspires axiological aspirations od people of their time. The study also discusses the problem of the fundations of law, its ties with power and governing. A separate problem is demoratisation of the law and saturning it with humanistic ideals. However, these issues call for a non-doctrinaire discussion, in which we should remember about the future rather than obedience to the doctrines of the past. (original abstract)
