Abstrakty
Omówiono zagadnienie dotyczące śmierci, jej definicje i wątpliwości związane z nimi. Przedstawiono zagadnienie norm prawnych w przypadku wystąpienia śmierci naturalnej i śmierci nienaturalnej: śmierć gwałtowna, tragiczna, samobójcza, eutanatyczna, w stanach wyższej konieczności, podczas wojny oraz na mocy sądowego orzeczenia kary smierci.
The law defines normative paths leading from wanted death (suicide, euthanasia) to conceivable death (self-defence, state of necessity, war, disasters, accidents) to compulsory death (death penalty). These are at the same time the paths of high controversies in evaluating all these forms of unnatural death. Controversies accompanying the regulation of death by law start already with a great number of currently known definitions of death (pathological, physiological, clinical, biological, circulatory, brain death, direct and indirect, absolute, relative, civil, and actual). These definitions greatly influence the typical cases of unnatural death regulated by law: suicide, euthanasia, states of necessity, cases of conceivable death (war, disasters, accidents), and death penalty.
