Abstrakty
W artykule przedstawiono prawne aspekty czynności medycznych, zabiegów lekarskich, warunki legalności czynności leczniczych oraz zagadnienie eksperymentu medycznego.
The article deals with the conditions for the admissibility of medical procedures. The author makes a brief survey of views on the legal nature of medical procedures, or the concept of the primary and secondary legality of tratment procedures. She supports the view that grants the atribute of primary legality to treatment procedures. The paper then discusses the prerequisites of the legality of medical actions (procedures), which, under the statute on mediccal profession, embrace: the carrying out of a procedure by the legally qualified person, to the best of current medical knowledge, in compliance with professional ethics and with due diligence, for the purpose of treatment, and with the patient's consent. The author has devoted considerable room to the discussion of and the author's position on the requirement of obtaining the patient's consent to medical procedures. The concluding part of the paper is devoted to the problems of the medical experiment. The author presents a short analysis of the regulation of the problem in the new law on medical profession.
