Abstrakty

W artykule przedstawiono analizę funkcjonowania powództw o ustaleniu istnienia stosunku pracy w orzecznictwie sądowym okręgu Sądu Okręgowego w Katowicach. Analiza obejmuje okres od II półrocza 1996 do końca I półrocza 1999 r. Pokazano mechanizmy działań zmierzających do zastępowania faktycznie wykonywanej umowy o pracę umowami cywilnoprawnymi.

District Courts of the Labour Courts of the Regional Court in Katowice have indicated a small number or cases concerning the establishment of labour relation. From the moment of introduction of the act about the change of the act - Labour code as well as the change of some other acts, i. e. since the second quarter of 1996 only 415 labour relation establishment claims reached the court. This constitutes only 0,37 procent of the total of cases investigated by District Courts - Labour Courts. What deserves a distinction is the attitude of the courts. Taking into consideration the fact that such cases are not easy the activities of the courts have to be highly regarded. From the total of cases concerning the establishment of the labour relation 68,9 procent have been solved. The number of cases in progress is 39, which constitutes 9,4 procent of all cases concerning the establishment of labour relation dealt with by the District Courts - Labour Courts.
