Abstrakty

Tematem artykułu jest problem podziału ryzyka między strony biorące udział w realizacji przedsięwzięcia inwestycyjno-budowlanego, wykorzystując do tego celu umowy o roboty budowlane. Uwagę skupiono na umownych warunkach płatności za wykonane roboty, które powinny być starannie dobrane do konkretnych okoliczności w których podejmowane jest przedsięwzięcie.

The author discusses the problem of dividing risk between an investor/client and a contractor of building work via construction work contracts concluded with this aim in mind. The division of risk is possible thanks to the principle of freedom of contract, within the framework of which, and through appropriate clauses, the desired effect can be achieved. It is thus fundamentally important in this light to specify the terms of payment for work undertaken. The author discusses the division of risk in contracts involving a fixed price, a reimbursement of costs, and target costs. In the final part of this article, the author sheds light on the problem of sharing risk in contracts concerning the management of a construction project. (original abstract)
