The Origins and Concept of Consensuality in Criminal Proceedings

Wprowadzenie do polskiej ustawy procesowej z 1997 roku nowej instytucji skazania bez rozprawy, jest efektem działań zwolenników porozumiewania się uczestników postępowania karnego i uzgodnienia przez nich dalszego toku procesu, a nawet treści konkretnej decyzji sądowej. Jest to właśnie wprowadzenie elementów konsensualizmu (konsensusu, porozumienia) pomiędzy stronami (uczestnikami) procesu karnego. Autorka przedstawiła ewolucję koncepcji konsensualizmu i prześledziła jej rozwój na gruncie polskiego prawa karnego.
The new 1997 Code of Criminal Procedure, which came into force on 1 September 1998, introduced communication between the parties in the criminal proceedings and co-ordination by them of its further course. Thus, along with the classic settlement of disputes, the parties are now allowed to arrive at an agreement before the criminal court on the basis of consistent declarations, that is a consensus. After presenting a definition of consensus, the author discusses in detail the sources and roots of consensuality in the theory and philosophy of law. She explains the communication theory of law and society formulated by a German philosopher of law, Jurgen Hebermas, in which discourse in the basic principle of organizing social relations. At the same time she presents the criticism of the so-called classic legal proceedings and names the rules upon which the proceedings should be based in the interpretation of the consensuality conception. In conclusion, the author stresses the fact that the institution of agreements introduced in the Polish criminal proceedings (Articles 335 and 387 of the Code of Criminal Procedure) compiles with the recommendations of the Council of Europe's Committee of Ministers.
