Abstrakty
Stawia się pytanie czy prawo UE jest instrumentem właściwym dla zwalczania tego rodzaju dyskryminacji. Według utrwalonego poglądu, UE nie zajmuje się kwestiami związanymi z "moralnością", które - zgodnie z zasadą ograniczonych kompetencji i subsydiarności, pozostają w wyłącznej kompetencji państw członkowskich. Z drugiej strony, fundamentalna dla prawa UE zasada poszanowania praw podstawowych wymusza aktywność Unii w tej dziedzinie, ponieważ prawo do niedyskryminacji ze względu na orientację seksualną zostało uznane w Karcie Praw Podstawowych jak również w orzecznictwie Europejskiego Trybunału Praw Człowieka. Przyjęto również w 2000 roku Dyrektywę Ramową, zabraniającą dyskryminacji między innymi ze względu na orientację seksualną.
