During the summit in Brussels in December 2003 Poland and Spain did not accept the new mechanism of decision making in the European Union's Council of Ministers, proposed by the European Convention. Under the new rules, it would take a simple majority of half the 25 states to pass laws, provided they comprise 60 per cent of the EU's total population. Both countries, especially Poland, have been criticized for their defense of the formula agreed at Nice in 2000, giving each of them almost as many votes as Germany, even though they have less than half the population. Author's objective is to explain the sense and meaning of this controversy. He argues that in reality the Constitutional Treaty aims at withdrawing from the existing fundamental principle of the EU, i.e. from the rule that representation within Communities is not entirely proportional in terms of population. Population factor seeks to reflect directly the will of EU citizens, not the will expressed by governments - national representations of the Member States. Author of the article insists that the European Council and the Council of Ministers are bodies consisting of representatives of Member States, and not delegates of some mythical European nation. The weighed voting system provided in the Nice Treaty reflects power configuration among states, not power configuration resulting from pan-European elections. European Communities are legitimized thanks to powers and prerogatives given them by nation states and treaties. There in no convincing reason to change this arrangement at present stage.
