Abstrakty

Ustawa o radiofonii i telewizji była kilkakrotnie nowelizowana, ale jedynie dwukrotnie, w nowelizacji z marca 2000 r. i kwietnia 2004 r. udało się uwzględnić przepisy dostosowujące prawo polskie do standardów wspólnotowych. Artykuł zawiera diagnozę przedakcesyjną - stan dostosowania przed nowelizacja ustawy o radiofonii z kwietnia 2004 roku.

The fundamental obligation of Polish legislators resulting from the need to adjust Polish law to Community standards in audiovisual policy is implementation of Council Directive 89/552, amended by Parliament and Council Directive 97/36, on the coordination of certain provisions laid down by law, regulation or administrative action in Member States concerning the pursuit of television broadcasting activities, implemented in essence in the passage of the Act of 29 December 1992 on radio and television broadcasting. The author's comparative analysis of the Community directive and the Polish act is an attempt to determine precisely how advanced is the process of implementing Community regulations and to what extent Polish legislators have implemented them. Identifying the "critical areas" provides the basis for formulating a strategy for further legislative change. (original abstract)
