Abstrakty

Prawo użytkowania wieczystego jest przedmiotem wielu transakcji kupna-sprzedaży, a także profesjonalnych wycen na różne cele. Niniejsza praca jest przedmiotem metodycznej analizy wyceny prawa użytkowania wieczystego w oparciu o współczynnik korygujący względem prawa własności. Ma to zastosowanie tam, gdy jest niemożliwa wycena prawa użytkowania wieczystego podejściem porównawczym w oparciu o ceny transakcyjne. (oryg. streszcz.)

This article presents the analysis of the method of the perpetual usufruct law valuation on the basis of the empirical formula provided by the following record -The Regulation of the Gabinet in reference to the real estate valuation and the draft of the estimation survey. All possible cases have been analysed (1692), as regards the implementation of this formula, according to the values of the capitalization rate, the percentage rate of the annual fee and the number of years of the unused period of usufruct. The formula presents an abnormal dependence - that the value of a real estate increases along with the growth in the capitalization rate. That is the reason why there have been suggested two possible ways of solving the problem mentioned in the article. First a correction of the formula next the presentation of all possible dependence in a form of a table for all 1692 cases has been presented in the article. (original abstract)
