Abstrakty

Samorząd hiszpański jest trójszczeblowy i składa się z gmin, prowincji i wspólnot autonomicznych na poziomie regionalnym. Taki podział i terminologia wynikają z konstytucji Hiszpanii. W praktyce jednak liczba typów jednostek lokalnych jest szersza. W artykule scharakteryzowano takie rodzaje jednostek jak: prowincja, wyspa, gmina, mancomunidad, strefy metropolitalne, comarca oraz miasta autonomiczne.

Using the case of Spain, the article discusses ways in which local self-governments fulfill their tasks. The basic units of self-government are communes and provinces. Autonomous communities constituting the regional level of self-government have the right to regulate specific areas of activities undertaken by communes and provinces. One of the areas is communes' entering into various unions. In Spain, three types of unions are commonly present: mancomunidades, metropolitan zones and comarcas. Each has legal personality and legal capacity, different managing bodies and they are established in a distinctive way. The article characterizes their specificity. In addition to the three types of unions, two special units of administration have to be mentioned, i.e. Islands (las Islas) established on the Canary Islands and Balearic Islands and autonomous towns represented by two enclaves on the territory of Morocco in North Africa. Unions are a must for the communes, because almost 61% of them have populations below 1,000, which fact prevents from providing the residents with public services at a level comparable with larger communes. Spanish solutions can provide an interesting source of inspiration for other countries, including Poland. (original abstract)
