Abstrakty

Celem projektu badawczego jest ukazanie miejsca decydowania komitologicznego w systemie decyzyjnym Wspólnoty Europejskiej poprzez analizę całego systemu decyzyjnego, podstaw prawnych komitologii, orzecznictwa sądów wspólnotowych w tym zakresie, a także praktyki komitologicznej. Jeden ze środków osiągnięcia tego celu stanowić może próba stworzenia empirycznego modelu komitetu komitologicznego, wynikająca z pogłębionej obserwacji rzeczywistej struktury i funkcjonowania wielu tego typu komitetów. Model ten może stać się podstawą teoretycznej oceny decydowania komitologicznego. (fragment tekstu)

The concept of comitology was introduced into academic language in order to define the existence and operation of a specific type of committees in the European Community's institutional system. The research project described in the paper is geared to show the place of these committees in the decision-making system of the EC. This is to be achieved by presenting the EC's entire decision-making system, legal foundations of comitology, case law of Community courts in this respect, as well as comitological practice. One of the means of tackling this task is the construction of an empirical model of a comitological committee, based on the keen observation of the authentic structure and operation of many such committees. At the same time, the evaluation of comitology in the light of integration and democracy theory remains the prime concern of the project. The statement that member states have a profound effect on the centralized implementation of community law, in keeping with the basic rule of democracy, is the thesis of the research project. Despite the fact that the Commission is the executive institution of the Community, the shape of the legislation is affected and oftentimes, determined, by the committees made up of member-state representatives. This demonstrates that strong intergovernmental elements have been accommodated into the procedures commonly seen as an expression of the supra-national nature of the European Community. The author emphasizes that the strictly analytical layer of the paper calls for a decisional approach in its systemic, organizational and inductive version. Due to the necessity of analyzing documents (reports, legal acts, court decisions, and others) the statistical, comparative and logico-linguistic method should also be used.(original abstract)
