Abstrakty

Zjawisko molestowania seksualnego po raz pierwszy na gruncie prawnym rozpoznane zostało w latach 70. w USA. W Europie zainteresowanie tym problemem pojawiło się niemal 20 lat później (w połowie lat 90). W Polsce prawną definicję molestowania seksualnego przyniosła dopiero nowelizacja Kodeksu pracy z 14 XI 2003 r. W polskim ustawodawstwie nadal brakuje jednak przepisów kompleksowo i spójnie regulujących opisywane zjawisko, a samo molestowanie wciąż wydaje się być traktowane przez społeczeństwo jako tabu. Celem artykułu jest prezentacja mało znanych w Polsce rozwiązań amerykańskich. Zdaniem autorki, stanowić one mogą pomocny wzorzec przy wypracowywaniu modelu prawnej ochrony pracowników przed molestowaniem seksualnym w naszym kraju. (abstrakt oryginalny)

The phenomenon of sexual harassment has been identified for the first time on legal field in 70s in the USA. An interest in this problem turned up in Europe almost 20 years later (in the mid - 90s). In Poland the legal definition of sexual harassment has been brought by the amendment of labour code from 14 November 2003. However there is still lack of regulations in Polish legislation, comprehensively and coherently regulating the described phenomenon and still harassment seems to be treated by the society as a taboo. A purpose of this article is a presentation of few known in Poland American solutions. In author’s opinion they can be helpful pattern in working out the model of legal protection of employees against sexual harassment in our country. (original abstract)
