Abstrakty

Pracowniczy pakiet medyczny jest oferowany przez pracodawcę w dwóch formach: prywatnego ubezpieczenia zdrowotnego lub quasi-ubezpieczenia bezpośrednio na podstawie umowy ze świadczeniodawcą usług zdrowotnych. Adresatami oferty są na ogół wyżej kwalifikowani zatrudnieni (niekiedy także członkowie ich rodzin). Podstawowa kontrowersja w tym przedmiocie dotyczy opodatkowania tego świadczenia. Administracja podatkowa i niektóre sądy administracyjne stanęły na stanowisku, że pakiet medyczny jest niepieniężnym świadczeniem ze stosunku pracy podlegającym podatkowi jak wynagrodzenie za pracę. Ubezpieczyciele i świadczeniodawcy usług zdrowotnych uważają, że takie ubezpieczenie nie jest świadczeniem ze stosunku pracy, a wartość udzielanych świadczeń zdrowotnych jest trudna do ustalenia. Oczekiwane jest rozstrzygnięcie spornej kwestii prawnej przez NSA. Spór o pakiet medyczny ma związek z szerszą problematyką prywatyzacji ochrony zdrowia i obawy przed selekcją ryzyka niezdrowia. Autor przedstawia argumenty na rzecz tezy, że pracowniczy pakiet medyczny podlega podatkowi (PIT) jako świadczenie z tytułu zatrudnienia. (abstrakt oryginalny)

The employee medical package in Polish firms is offered voluntarily by the employer in two forms: regular private health insurance or "health insurance" provided for by medical care organizations (MCOs). Beneficiaries are usually higher qualified employees (exceptionally also family members) and the scope of coverage depends on the employee status of the beneficiary. The most controversial point became the taxability of the benefit as the personal (employee) income . The tax administration and a few administrative court decisions view the benefit as a non-monetary remuneration and therefore taxable like wage income. Private insurers and MCOs as well as some lower administrative courts take the opposite view. A High Administrative Court decision is needed and expected. The discussed issue reflects the general controversy over the future of public and private health insurance and the fear of risk selection by both, insurers and MCOs. The Author's point is that the employer financed "health package" is a part o the employment relationship and that the taxable benefit relates to the cost of the insurance (in both forms) and not to the fact of providing health care in individual cases.
