Szczegółowy przegląd branży dokonany przez Komisję wykazał, że żegluga liniowa nie jest branżą wyjątkową, ponieważ jej struktura kosztów nie różni się zasadniczo od innych branż. Dlatego też nie ma dowodów, że konferencje żeglugowe muszą być chronione przed konkurencją.

Application of the rules on competition in the maritime transport sector has been subject to the provisions of Regulation No 4056/1986. This Regulation originally had two functions. Firstly, it contained procedural provisions for the enforcement of Community competition rules in the maritime transport sector. Secondly, it laid down certain specific substantive competition provisions for the maritime sector and notably a block exemption for liner shipping conferences, allowing them to fix prices and regulate capacity under certain conditions. Council Regulation No 1/2003 on the implementation of the rules on competition laid down in Articles 81 and 82 of the Treaty amended Regulation No 4056/1986 to bring maritime sector under the common competition enforcement rules applicable to all sectors with effect 1 May 2004, with the exception of cabotage and international tramp vessel services. However, the specific substantive competition provisions relating to the maritime sector continue to fall within the scope of Regulation No 4056/1986. A thorough review of the industry carried out by the Commission has demonstrated that liner shipping is not unique as its cost structure does not differ substantially from that of other industries. There is therefore no evidence that the industry needs to be protected from competition. Liner shipping conferences therefore no longer fulfill the conditions for exemption under Article 81 of the Treaty and the block exemptions in respect of such conferences should therefore be abolished. In the light of, Regulation No 4056/1986 has been repealed in its entirely by Council Regulation No 1419/2006.(original abstract)
