Abstrakty

W związku ze zwiększeniem się nacisku na ochronę konsumenta w krajach rozwiniętych, w tym w ramach UE, oraz wzrostem operacji międzynarodowych polskich przedsiębiorców ryzyko generowane przez wprowadzenie do obrotu produktu niebezpiecznego powinno stać się istotnym elementem w analizie ryzyka przedsiębiorstwa także na polskim rynku. W artykule przedstawione zostały obecne tendencje w zakresie przedmiotowego ryzyka oraz możliwości wykorzystania ubezpieczenia dla pokrycia strat wynikających z jego realizacji. (fragment tekstu)

Product liability risk - in view of possible wide range of negative consequences, their mass character for some sectors potentially, predominating role of personal injuries and infringements of reputation and customers trust - belongs to essential (killer) risks. Especially because of the significant increase of the number and values of product liability claims on European and American markets over the last years. The risk concerned should be an important element of a risk management process also for enterprises on the Polish market because of escalation of consumer protection in the developed countries and growth of international operation of Polish companies. Current trends and regulations in the product liability area have been presented in the article, with differences between European and American markets. A wide scope of possible negative consequences has also been discussed, including personal injuries, consequential losses, and many additional costs such as product recall expenses, and many others. A typical structure of insurance cover of product liability risk has been briefly presented focusing on the most important elements such as: object of a contract, common important exclusions, limits and deductibles, triggers and serial claims.
