Abstrakty

Ponieważ przepisy regulujące wspólną politykę handlową nie były przedmiotem kontrowersji w toku ratyfikacji traktatu konstytucyjnego, zostały bez zmian merytorycznych przeniesione do Traktatu z Lizbony. Zmiany regulujące wspólną polityką handlową Unii Europejskiej wprowadził art. 2 Traktatu z Lizbony, który zawierał poprawki do obowiązującego Traktatu ustanawiającego Wspólnotę Europejską (TWE) i zastąpił go Traktatem o funkcjonowaniu Unii Europejskiej. Autor opisuje również kwestie pominięte w Traktacie o funkcjonowaniu UE oraz nowe rozwiązania instytucjonalne wprowadzone Traktatem z Lizbony.

The article presents changes to the provisions on the EU Common Commercial Policy (CCP) introduced to the founding treaties by virtue of the Treaty of Lisbon amending the Treaty on European Union and the Treaty establishing the European Community. The scope of the CCP has been expanded to include foreign direct investment. The new treaty shifts commercial policy unequivocally to the area of Union's exclusive competences with Council acting by a qualified majority or - as an exception - unanimously. Measures defining the framework for implementing the CCP will be adopted in accordance with the ordinary legislative procedure, i.e. by the European Parliament and the Council. The essay also analyses the modifications to the procedure guiding the negotiations and conclusion of the agreements between the EU and third countries. The new procedure increases the role of the European Parliament that has to give its consent to all agreements covering fields to which the ordinary legislative procedure applies, including all CCP agreements. Moreover, as far as negotiations of trade agreements are concerned, the Commission will be regularly reporting their progress not only to the Council's special committee, but also to the European Parliament.
