Abstrakty

Procedury pozyskiwania funduszy strukturalnych i Funduszu Spójności i zarządzania nimi są źródłem błędów. Ich wykrywaniem zajmuje się Trybunał Obrachunkowy, Komisja i państwa UE. ETO w corocznych sprawozdaniach przedstawia błędy oraz ocenę systemów kontroli KE i państw UE. W ostatnich sprawozdaniach ETO pojawia się zapis: Trybunał nie może wydać opinii bez zastrzeżeń co do legalności i prawidłowości rozliczeń. Konieczne są starania o skuteczne wdrażanie systemu kontroli oraz eliminowanie niedociągnięć, przede wszystkim w zakresie polityki spójności. Celem artykułu jest dyskusja nad uproszczeniem zarządzania funduszami i przedstawienie oceny efektów podejmowanych działań. Oceny TO powinny być brane pod uwagę przez instytucje państw UE zajmujące się nadzorowaniem projektów finansowanych przez fundusze UE w celu uniknięcia błędów przyszłości. (abstrakt oryginalny)

Complicated procedures of obtaining and managing Structural Funds and the Cohesion Fund are the source of irregularities and errors in these processes. The European Court of Auditors, European Commission and member states' control systems deal with detecting those discrepancies. In its Annual Reports on the implementation of the EU general budget and in the other reports, the Court presents the detected errors and evaluates control mechanisms in the EU member states and the European Commission. In subsequent years the Court's reports include (in an almost unchanged version) the following statement referring, among others, to structural activities: "The Court is again not in a position to provide an unqualified opinion on the legality and regularity of underlying transactions. A greater effort is needed to implement the supervisory and control systems effectively and to address the weaknesses in the areas where payments are still materially affected by errors". In the greatest extent it relates to the cohesion policy. The aim of the paper is a short survey of the discussion about simplification, coordination and flexible management of the Structural and Cohesion Funds and opinion of the Commission and the European Court of Auditors about the effects of undertaken measures. Conclusions and recommendations contained in the last reports of these institutions show still existing problems. The recommendations should be analyzed thoroughly by the Member States' Managing and Paying Authorities supervising the projects co-financed by the European Union, which should prevent the indicated irregularities and errors in the future.
