In the last phase of work aimed at laying the foundations of European Civil Law, solutions were put forward concerning issues linked with parties to obligatory (contractual) relationships. As part of this work, rules were proposed for normalising the issues of a change in the parties to a contractual relationship and the plurality of parties. The author describes the adopted solutions against the background of the relevant institutions of Polish law. In particular, he discusses the adopted division of obligations into solidary, separate and communal, and notes the differences between them. What should be emphasised is the greater protection given to the creditor's interests in connection with the breach of the principle that "solidary liability cannot be alleged" and the treating of communal obligations as a separate category. The next two chapters deal with regulation of the institution of assignment and the substitution of new debtors. The regulations concerning assignment are complex and do not deviate significantly from the assumptions adopted in Polish law. However, we can clearly notice efforts towards protecting the interests of the debtor. As regards the regulations on contracts on the substitution of debt, what is noteworthy is the lack of requirements concerning the form of said contracts. In other respects, such contracts do not differ significantly from the principles applied in Polish law. Finally, it should be noted that the architects of the Principles of European Contract Law (PECL) proposed a conception of "assignment" that is unknown in Polish civil law, namely, the complete assignment of the rights and obligations of one of the parties to an existing contract. In summary, it should be stated that the proposed regulation does not differ significantly from the principles adopted in Polish law; the differences do not relate to the structure of the discussed institutions, but only involve greater emphasis on protecting a given party to a contractual relationship.
