Stałym problemem występującym w przypadku działalności koncyliacyjnej było to, jak zastąpić środki siłowe pokojowym rozwiązaniem sporów międzynarodowych. Obserwując rozwój prawa zwyczajowego – a w istocie ewolucję każdego z głównych systemów prawa, zarówno świeckiego, jak i religijnego – dochodzimy do wniosku, że były one w większym lub mniejszym stopniu historią wysiłków idących w tym właśnie kierunku. (…) W niniejszym artykule przez analizę doświadczeń wynikających z posługiwania się procedurą wyjaśniania faktów w pokojowym rozwiązaniu sporów międzynarodowych podjęto próbę lepszego zrozumienia ich możliwości i ograniczeń. The research proceeding is an institution created by the 1899 Hague Convention on the peaceful resolution of international disputes. It consists in the activity of a commission, essentially a joint organ available to both sides and appointed by either conflicting parties or governments appointed by them. The extent of its plenipotentiary power is determined in advance by the parties, and the commission’s ruling is established on either a particular case or for a certain period of time. The commissions’ procedures can be established by the conflicting parties, and be either permanently binding or specific to an individual case. They serve a subsidiary function to complement direct negotiations, their role being to facilitate conflict resolution through fact-finding on the strength of impartial and conscientious research. The commission issues a report on its decisions, but does not possess the ruling power of an arbitration court. The conflicting parties reserve the right to use these reports. The Hague Convention of 1907 contained additional rulings on the commissions’ procedures, and two parties may adopt them, in full or in part, for their particular case. Through analysis of experiences resulting, from the use of the fact-finding procedure in the peaceful resolution of international disputes in the light of the activity of the first commissions’ research and the more limited experiences of the League of Nations and the United Nations, the article attempts to better understand their limitations and potential capabilities. Research on the particular procedure described herein should be distinguished from the general process of establishing facts. (original abstract)
