Abstrakty

Celem pracy jest analiza projektu Solvency II w kontekście towarzystw ubezpieczeń wzajemnych. Reprezentanci ubezpieczycieli wzajemnych zwracają uwagę, że nowe regulacje powinny uwzględniać specyficzne potrzeby i uwarunkowania działalności TUW, gdyż w przeciwnym razie przyszłość tej grupy przedsiębiorstw ubezpieczeniowych będzie niepewna. The aim of the paper is to present the specific environmental requirements and expectations of European insurance companies operating as mutual insurance companies in work upon the implementation of the Solvency II project. Issues requiring specific considerations for the particular form which is TUW include the equity structure, the exclusion of small TUWs, subordinated debt, taxation, the principle of proportionality, market and product specialisation, diversification, capital requirements, and European mutual insurance companies. The article explains the basic principles of Solvency II, and presents the position of mutual insurance companies operating on the European insurance market. The summary examines the experience the banking sector gained in applying the new Basel Capital Accord (Basel II) in the context of the financial market crisis in the second half of 2008. Conclusions from the analysis of the flaws of Basel in response to the crisis will no doubt prove valuable guidance in improving, based on similar assumptions, a new appraisal system for solvency in the insurance system. In the final section the author concludes that Solvency II needs to be implemented to improve the safety, efficiency and competitiveness of the European insurance market. Given the scale of complexity and impact on economic conditions, the implementation should be done with a view to achieving a reasonable compromise between the demands of various interest groups, including insurers doing business in the form of mutual insurance companies.
