In the first part of the article the law instruments and the mechanism of their functioning are discussed on the example of a civil-legal privity within which the functioning or the economic incentives is realized. The difference is stressed between the traditional approach to the privity (formal "freedom of agreements") and its new concept in the collectivized turnover where most of the civil-legal privity elements are .excluded from the formally free disposal of parties. The function of the civil-legal privity is protection of the interests of parties. The term X "interest" of a unit of the socialized economy is an ambiguous one. Any attempt made to define it accurately leads to the conlusion that there may exist a conflict between the particular interest of specific enterprises as well as a conflict bettwen particular interests of the enterprise on one hand and the public welfare on the other. In the second part of the article there are presented some examples of the functioning of the two most important legal instruments for achieving the protection of the public economic welfare in case of a conflict with the particular interest of an enterprise. These instruments forming the conventional link (connection) (civil-legal privity) between parties are: administrative act and agreement. (original abstract)
