Konkretne krajowe regulacje prawne są wypadkową roli, jaką przypisuje się państwu w gospodarce oraz ograniczeń przyjętych do systemu prawnego, wskazanych w prawie Unii Europejskiej oraz Konstytucji RP. To one dają odpowiedź, czy i jak dalece dopuszczalna jest ochrona socjalna, na ile można angażować środki publiczne wprost w gospodarkę (zgodnie z teorią J. M. Keynesa) a na ile prymat mają zasady wolności gospodarczej i konkurencji. (fragment tekstu)

After several economic crisis in 20th century, economists had developed many opinions on the role of state intervention in economy. Among them the idea of social market economy has been presented. It became an element of the Polish legal system in 1997 as it had been chosen as the national social and economic system in Polish Constitution. It may also become an element of European law, if and as soon as the Constitution for Europe comes into force. However standing alone, it does not put strict borders for public finance intervention in the national economics. All member states are obliged to subordinate their economic policy with general European aim and politics. Based on free and competitive market economy the European law does not allow the member states to provide state aid, other than in extraordinary circumstances. For example, unless such state aid is meant to remedy a serious disturbance in the economy of such Member State. The EC is also determined to initiate joint actions and coordinate those of particular member states in order to fight the consequences of financial crisis. An example of such coordination is put down in the European Economy Recovery Plan adopted in Brussels on 11-12. December 2008. The provisions of this document must be kept, while Member States decide on their own intervention instruments. (original abstract)
