In the time of crisis, new Acts regarding public- private partnership, building work licences and service licences seem to be a very interesting solution which will enable to start stable public undertakings. In comparison to the previous Public Procurement Law, the current legal regulations simplify procedure of choosing a private partner. It will also be possible to use the procedure based on the Licences Act in organising undertakings according to Public- Private Partnership Act, providing the private partner has right to derive benefits from the subject of partnership as his earnings. In case earnings of a private partner come from a public partner, the private partner shall be chosen on the basis of Public Procurement Law. The article discusses novelties in the procedure of choosing private partners for realising undertakings according to public- private partnership in a new legal system. (original abstract)
