Abstrakty

W artykule tym podkreślona zostanie różnica między zmianą właściciela kapitału rzeczowego a zmianą zasad wykonywania pracy osób świadczących usługi medyczne. Warto przy tym zwrócić uwagę, że termin „prywatyzacja” w kontekście przekształceń własnościowych w ochronie zdrowia w Polsce jest często nadużywany i stosowany nieprawidłowo. Podobnie rzecz ma się z określeniem: „prywatyzacja usług zdrowotnych”, które używane jest do opisywania zjawisk odnoszących się do prywatyzacji majątku służącego do świadczenia usług zdrowotnych, a nie do samej zmiany zasad świadczenia pracy wykonywanej przez lekarzy i personel medyczny. The authors discuss the current issue of ownership and organisational changes in the medical services sector in Poland. Human health is not a good which can be subordinated to market, legal or economic mechanisms. Quite the opposite, all services delivering healthcare are subordinated to these mechanisms. Similar to others, medical services forego technological modifications, but they are also limited by the efficiency of personnel and the irreducible and essential time in which the service must be provided. The drive for entrepreneurship and innovation in medical services is occurring in the healthcare sector, and the current period of ownership transformation is conducive to making decisions. The article describes examples of entrepreneurial privatisation, restitution and the reprivatisation of assets. Two fundamental factors which have a direct influence on the level and quality in the provision of medical services are distinguished - the assets (facilities and equipment) and the personnel (their knowledge and skills). The status of the assets and personnel - capital and labour determine the proper operation of the entire medical services sector. “Privatisation” in the healthcare system refers to both factors at the same time. While the transformation involves change in the ownership structure of the real estate where healthcare is delivered, it also consists of the change occurring in the way that healthcare is provided by medical personnel. The distinction between changes in the ownership of capital and changes in the rules governing medical personnel is emphasised in the article. (original abstract)
