Abstrakty

W artykule poddano analizie politykę lotniczą Wspólnoty Europejskiej wobec Stanów Zjednoczonych. Jej regulacje są właśnie wypadkową stanowisk państw członkowskich i Komisji. W pracy szczegółowo omówiono przepisy pierwszego etapu porozumienia oraz przeanalizowano korzyści płynące z osiągniętego kompromisu. Prezentuje ona dotychczasowe rezultaty także drugiego etapu negocjacji. Ukazano w niej też obecny stan lotniczych regulacji w ramach Wspólnoty. Skupiono się na stosunkach lotniczych Wspólnoty i jej państw członkowskich ze Stanami Zjednoczonymi, regulowanych w dużym stopniu przez umowę Open Skies zawartą 25 kwietnia 2007 r. w Brukseli, a także zarysowano perspektywy rozwoju transatlantyckich relacji lotniczych w obliczu toczących się negocjacji drugiego etapu umowy. This article discuses aviation relations between the European Union and the United States. It analyses opportunities and threats that arise for air carriers from the agreement made between the United States on the one part and the European Union and its Member States on the other part. Additionally the article presents some outcomes from the negotiations of the second stage of the agreement as they were known at the moment of writing (fall 2009). The article starts with a short explanation of the internal regulatory liberalization of air transport that took place in the European Community in 1990s. It proceeds with analyses of the European Commission's willingness to regulate the external scope of air transport. It discusses the European Court's of Justice judgments in Open Skies-related cases. With a focus on the Air Transport Agreement concluded between The United States on the one part and the European Community and its Member States on the other part in April 2007, it analyses current regulatory environment. As a conclusion the article comments on the current stake of affairs and outlooks beyond the 2007 Agreement. (original abstract)
