Abstrakty

W odniesieniu do umowy jako narzędzia realizacji celów należy zauważyć, że podmiot polityki w ograniczonym stopniu ma możliwości kształtowania jej zgodnie ze swoją wolą, gdyż w równym stopniu jej kształt zależy od woli partnera lub partnerów porozumienia. Tak więc jej kształt jest na ogół wynikiem kompromisu między jej sygnatariuszami.(fragment tekstu)

Regulation is generally associated with control over the adherence to state dictated norms concerning activities vital to the community. These norms include rules and principles of action, as well as legal limitations. A key feature of regulation is its formalized character and the fact that adherence to the norms is controlled by a regulatory agency independent of the regulated entities and executive power. Such an agency possesses the competence of administrative discretion, which means that it may adjudicate some cases differently in spite of their similar factual status. That justifies perceiving regulatory agencies as subject to policy. Their scope of action may be established in two ways: 1. Through determining of the economic processes occurring in any economic sector, where regulation affects those entities that meet the criteria established by the law. 2. Through determining of the regulation-subjected entities which operate within a particular sector. Regulatory actions aimed at achieving desired effects are always accompanied by costs linked with the functioning of the regulating body and generated by regulation within the regulated entities with these affects and costs being of different nature and it being difficult to find their common denominator, which hinders the making of rational decisions.(original abstract)
