Wzory protokołów z negocjacji komisji konkursowej NFZ z oferentami mają znaczenie nie tylko dla dokumentowania przebiegu i wyniku negocjacji, ale także dla faktycznego przebiegu negocjacji, a przez to dla wyników konkursu ofert. Obecnie w negocjacjach komisji konkursowej NFZ z oferentami stosowane są dwa wzory określone przez Prezesa NFZ: "Protokół z negocjacji" oraz "Protokół końcowy z negocjacji". Wskazane wzory nie zawierają formuły oraz przypisanego do niej pola przeznaczonych na dokumentowanie przebiegu negocjacji. Niedokumentowanie przebiegu negocjacji stwarza władzę komisji konkursowej polegającą na faktycznej zdolności do działania na korzyść jednych oferentów, a także do działania na niekorzyść innych oferentów. Zdaniem autora, taka pozycja komisji konkursowej, zagrażająca równemu traktowaniu oferentów oraz uczciwości negocjacji, powinna zostać wyeliminowana przez zmianę stosowanych wzorów z negocjacji, tak aby zapewnić dokumentowanie przebiegu negocjacji. Templates of minutes drawn up in the course of negotiations of the competition committee conducted between the National Health Fund and tenderers are of a great significance not only in respect of documentation of the course and result of negotiations, but also in respect of actual course of negotiations and at the same time in respect of results of the competition of offers. Currently, two templates of minutes, specified by the President of the National Health Fund, are applied in negotiations of the competition committee conducted between the National Health Fund and tenderers: 'Minutes of negotiations' and 'Final minutes of negotiations'. Indicated templates do not include any formula nor a field assigned to it, designated for the documentation of the course of negotiations. Lack of documentation of the course of negotiations creates an authority of the competition committee consisting in an actual ability to act for the benefit of one tenderer and also to the detriment of the other. The said position of the competition committee threatening the equal treatment of tenderers as well as the integrity of negotiations, shall be eliminated from negotiations by means of a change of the applied templates in order to provide the documentation of the course of negotiations.
