Abstrakty

Celem tego artykułu jest analiza trzech zagadnień. Po pierwsze, należy rozważyć, jakie są możliwe modele rozwiązania konfliktu między obydwoma prawami (prawo do ochrony życia prywatnego oraz prawo dostępu do informacji), zwłaszcza w odniesieniu do osób publicznych. W tym celu porównane zostaną rozwiązania amerykańskie, francuskie i angielskie. Po drugie, analizie poddane zostanie stanowisko Europejskiego Trybunału Praw Człowieka w tej materii - wyrażone najpełniej w precedensowym orzeczeniu w sprawie Karolina Von Hannover v. Niemcy. W trzeciej części artykułu weryfikacji poddana zostanie teza, że orzeczenie w sprawie Von Hannover położyło fundament pod tworzenie wspólnego, europejskiego standardu ochrony prywatności osób publicznych. Na koniec rozważane zostaną możliwe kierunki rozwoju orzecznictwa tej materii w przyszłości. (fragment tekstu)

This paper dwells on the topic which is gaining increasing importance in contemporary societies, namely the conflict between the right of public figures to protect their privacy and the mass media's right to free speech. It covers legislation specifying the scope of privacy protection in the US, Great Britain, France and the position of the European Human Rights Tribunal. The author argues that the Tribunal's decision on the Von Hannover case provoked the creation in Europe of a common standard of public figures' privacy protection. It contributed to the unification of decision making by European courts in cases where privacy protection and freedom of speech are in conflict. (original abstract)
