Abstrakty
Najważniejszym celem tzw. analizy tax expenditures (TEs) jest identyfikacja elementów konstrukcji podatku, których funkcjonowanie w systemie podatkowym skutkuje uszczupleniem wpływów do budżetu. Przyjmuje się, że właściwie przeprowadzona analiza pozwoli na wykazanie, że stosowanie tego typu instrumentów powoduje naruszenie podstawowych zasad podatkowych, tj. zasady efektywności, sprawiedliwości, czy też prostoty opodatkowania. Identyfikacji podlegać powinny wszelkiego rodzaju preferencje podatkowe, dzięki którym państwo wspiera ściśle zdefiniowane grupy podatników lub działalności. Z budżetowego punktu widzenia TEs mają taki sam skutek, jak bezpośrednie wydatki budżetowe, jednak w przeciwieństwie do tej kategorii nie podlegają tak rygorystycznym ograniczeniom i kontroli3. Przyczyny stosowania konstrukcji określanych mianem TEs są bardzo różne i wynikają z wielu przesłanek. Generalnie związane są z realizowaną przez rząd polityką fiskalną. Są też wynikiem funkcjonowania określonych uwarunkowań historycznych, prawnych, czy też instytucjonalnych.(fragment tekstu)
The lack of universal and generally acceptable definition of benchmark tax is one of the most important limitation of tax expenditures analysis. Without this it would impossible to named specifically tax preferences as tax expenditures or as a part of benchmark tax (tax base, tax rate, tax unit, tax period). Benchmark tax consists structural provisions which are necessary to implement a normal tax structure. Countries which present the tax expenditures budget accepted different definitions of benchmark tax. It is a result of individual character of tax systems in each country and individual tax objectives achieved by many taxes. That's why it is important to seek universal solutions in defining benchmark tax. It should be a useful tool in a fiscal transparency policy and in efficiency increasing of government activity.(original abstract)
