Abstrakty

Doskonalenie modelu ustrojowego samorządu terytorialnego jest zjawiskiem powszechnym w większości państw europejskich. Dlatego też podjęcie inicjatywy opracowania projektu zmian rozwiązań ustrojowych, które mają sprzyjać rozwojowi instytucji samorządu terytorialnego należy uznać jako zasadne i cenne. Przedmiotem artykułu jest krytyczna analiza projektu ustawy o wzmocnieniu udziału mieszkańców w działalności samorządu, w sprawie współpracy gmin, powiatów, regionów i zmianie niektórych ustaw.

The subject of the article is a critical analysis of a bill on strengthening of residents' participation in activity of a local government, on cooperation of communes, counties, regions and a change of some acts. The Author evaluates proposed solutions widening forms of residents' co-participation in realisation of public tasks (consultations, citizen's hearing, citizen's question, citizen's statutory initiative, new competencies of organs of ancillary entities, local activity associations and local activity committees) as premature, excessively developed and too much formalised, which can lead to decision-making paralysis of a local authority. In the Author's opinion such changes should be introduced in a way of evolution, after many-sided consideration. The Author also evaluates critically the drafted structural changes, in this particularly new forms of cooperation of local government entities in a form of obligatory county and regional conventions and teams of local cooperation and also cancellation of a collégial executive organ in a county and replacing it with a monocratic organ. Some of the proposed solutions can be assessed as unconstitutional, leading to weakening of a position of decisive organs, to deregulation of a task-competence system in the structure of local government entities. Summing up, the Author declares that the bill requires serious changes but it constitutes good grounds for discussion over improvement of the system of the local and regional self-government authority.
