Abstrakty

W opracowaniu rozpatrywane są zmiany instytucjonalne po socjalizmie na przykładzie Polski i wybranych krajów Europy Środkowej i Wschodniej z punktu widzenia: porządku prawnego, systemu organizacji oraz mechanizmów masowych i regularnych interakcji między ludźmi. Analizowane są takie problemy, jak: niestabilność i nadmierna szczegółowość legislacji, lekceważenie konstytucji przez posocjalistycznych ustawodawców, niski poziom egzekwowania prawa (tzw. luka wdrożeniowa). Badania nad ochroną prywatnych praw własności potwierdzają duże zróżnicowanie jej poziomu wśród krajów posocjalistycznych. Nadmiar regulacji i kontroli sprzyja korupcji na rzecz urzędników państwowych, a w konsekwencji rozwojowi szarej strefy jako nieformalnej formy ochrony praw własności. Z kolei badania empiryczne nad efektywnością sądów po socjalizmie wskazują na ich niską wydajność w niektórych krajach, zwłaszcza w Polsce, co świadczy bardziej o opóźnieniach w reformowaniu prawa i systemu sądownictwa niż wpływie dziedzictwa socjalizmu.(abstrakt oryginalny)

The article discusses institutional changes after socialism in Poland and some other countries of Eastern and Central Europe i.e. the changes in the legal framework, in the organizational systems, and the regular interactions between individuals. The author examines such issues as: unstable and excessively detailed legislation, disrespect for the constitution by post-socialist legislators, low level of law enforcement (the so-called implementation gap). The research on private property rights protection shows a substantial differentiation in this regard among post-socialist countries. Excess regulations and inspections contribute to corruption among public servants, which, in turn, leads to the development of the second economy. The empirical research on the courts after socialism indicates their low effectiveness in some countries, especially in Poland. This suggests that the delays in reforming the judicial system rather than the influence of socialist heritage, are the main reasons for such a low efficiency. (original abstract)
