W artykule przedstawiono doświadczenia polskie na forum ETS w ciągu 5 lat członkostwa Polski w UE: skargi wnoszone do Trybunału przez Komisję z tytułu uchybienia przez Polskę obowiązkom wdrożenia regulacji wspólnotowych, skargi polskiego rządu przeciwko organom WE wnoszone do ETS i SPI, skargi polskich osób prawnych i fizycznych kierowane do ETS, zapytania prejudycjalne polskich sądów oraz udział Polski w wybranych postępowaniach przed ETS w charakterze interwenienta. Szerzej omówiono dwie zakończone sprawy, mające poważne skutki prawne i finansowe. Omówiono także kompetencje, skład i organizację ETS oraz jego działalność. (fragment tekstu)

The article gives an overview of cases that have been brought before the ECJ by the Polish authorities, courts, companies or citizens, or by the Commission against Poland since Poland's accession to the EU. During the five years of Poland's accession to the EU, the Commission has initiated more than 100 actions against Poland, of which 22 cases were brought before the Court of Justice. Half of the cases were withdrawn by the Commission after explanation given or actions undertaken by the Polish authorities. In five other cases, the Court of Justice issued the judgment finding that Poland had failed to fulfill its obligation and ordered Poland to bear the costs of proceedings. At the same period, the Republic of Poland brought two cases before the Court of Justice and 8 cases before the Court of First Instance against institutions of the EC seeking the annulment of measures adopted by the Council or the Commission. Different Poland's courts referred 14 matters to the Court of Justice asking to clarify a point concerning the interpretation of the Community law. (original abstract)
