Abstrakty

Formalnie debatę o tym, jak dalece UE ma się zaangażować w pomoc USA w rozwiązaniu problemu Guantanamo, rozpoczęto 16 kwietnia 2009 r. Wtedy to na posiedzeniu ministrów sprawiedliwości i spraw wewnętrznych UE w ramach Komitetu Mieszanego (z udziałem Norwegii, Islandii i Szwajcarii jako państw stowarzyszonych grupy Schengen) zobowiązano Komitet Stałych Przedstawicieli (Coreper II) do zbadania możliwości wymiany informacji oraz ewentualnego przyjęcia osób, zatrzymanych wcześniej w Guantanamo, na terytorium państw UE i grupy Schengen. W kwietniu i maju 2009 r. odbyły się w Brukseli trzy spotkania ekspertów, a także dwa spotkania w gronie samych ambasadorów UE zebranych w Coreper II. Wynikiem prowadzonych dyskusji był kompromis w sprawie przyjęcia specjalnego mechanizmu współpracy między państwami członkowskimi UE i państwami stowarzyszonymi grupy Schengen w zakresie wymiany informacji z USA i współpracy w rozwiązaniu problemu Guantanamo. The article deals with problems over the closure of the Guantanamo Bay detention facility, and a fresh start in counterterrorism cooperation between the EU and US based on shared values, international law, the respect for human rights and the rule of law. About 250 detainees are still held - some without charge - at the Guantanamo Bay detention camp, which was set up after the 11 Sept. 2001 attacks to hold those accused of links to the al-Qaida terror network or the Taliban. In January 2010, US President Barack Obama is to close the Guantanamo camp by accepting the relocation of former inmates to the EU countries. About 60 inmates cannot return to their homelands as they could face abuse, imprisonment or death there. The US has asked EU countries to take in some of those cases. EU countries are likely to take in "several dozen" former prisoners. The decision on whether to accept former inmates from Guantanamo remains the exclusive competence of the individual Member States. Some EU countries, including Sweden and the Netherlands, have already ruled out accepting Guantanamo detainees at present. (original abstract)
