Technical Harmonization in the European Community - Review of the New Approach

Abstrakty
W drugiej połowie lat osiemdziesiątych ze względu na decyzję o wprowadzeniu w życie z dniem 1 stycznia 1993 r. przepisów o jednolitym rynku europejskim konieczne stało się usunięcie barier ograniczających swobodny przepływ towarów. Narzędziem, które miało ten proces ułatwić, była zaproponowana przez Komisję Europejską nowa metoda regulacyjna określana jako tzw. nowe podejście do harmonizacji przepisów technicznych. Podstawowe zasady tej metody zawarte zostały w Uchwale Rady z 7 maja 1985 r. w sprawie nowego podejścia do harmonizacji technicznej i normalizacji. Nowe podejście zostało w 1989 r. uzupełnione o tzw. globalne podejście do oceny zgodności, które określa metody stwierdzania zgodności wyrobów z przepisami technicznymi. Opisano je w Uchwale Rady z 21 grudnia 1989 r. w sprawie globalnego podejścia do oceny zgodności. (fragment tekstu)
The New Approach to the harmonization of technical regulations at EU level, introduced more than twenty years ago, has proven to be a very successful tool in facilitating free movement of goods in the Single Market. Nonetheless some of its elements require improvement. On 14 February 2007, the European Commission adopted its proposals for a regulation and decision within the framework of the revision of the New Approach. This article first presents briefly the main features of the New Approach, which make it a modern, flexible and technology-neutral regulatory technique. Then it describes the main identified problems and proposed changes. The first group of measures aims at increasing the credibility of notified bodies, organizations that intervene before the product is placed on the market. Other measures are proposed to strengthen the market surveillance performed by authorities at the stage when product is already circulating. Inconsistencies in terminology and lack of credibility of the CE-marking are also tackled. The article also describes the choice of legal instruments and its consequences. (original abstract)
