Abstrakty

Kompetencje legislacyjne Parlamentu Europejskiego w dziedzinie wymiaru sprawiedliwości i spraw wewnętrznych różnią się w zależności od tego, czy dane zagadnienie należy do I, czy do III filara UE. W każdym z filarów obowiązuje inny system podejmowania decyzji. W I filarze decyzje zapadają na płaszczyźnie wspólnotowej (ponadnarodowej), z udziałem Komisji, Parlamentu i Rady, natomiast decyzje w filarze drugim oraz trzecim podejmowane są na drodze ustaleń międzyrządowych w ramach Rady według tradycyjnych rozwiązań zaczerpniętych z prawa międzynarodowego publicznego. Authors present an overview of the European Parliament's position in the legal and institutional landscape of the EU's Justice and Home Affairs area. Their main argument flows from the recent ECJ case-law (PNR judgement), forthcoming entry into force of the Reform Treaty (the abolition of pillar structure) and the ever-growing amount of the JHA acquis: authors claim that presently it is the time of rapid re-awakening of the Parliament, which is playing actively its role on the JHA legislative plain and acquiring its important role, as the co- legislator alongside the Council. A limited preparedness of the Member States to co-act with the EP might lead towards interesting developments in the future. (original abstract)
