The article contains discussion of an issue belonging to disputable matters in courts' judicial decisions, i.e. a legal character of claims, vested to an expropriated person in a situation of unpunctual payment of damages for taken over or limited real rights in property. There were presented contrary standpoints consolidated in the judicature. The first of them includes performance of raising the amount and interest for delay in payment of compensation to the regime of civil law, simultaneously indicating civil proceedings before a civilian court as a way of asserting such entitlement. According to the second conception the discussed claims have the administrative-legal character, and therefore organs of administration should decide about them in the administrative-legal course. The Author of this article declares also for the second standpoint.(original abstract)
