W pierwszej części opracowania zostanie przedstawiona geneza, rozwój oraz idea odpowiedzialności międzynarodowoprawnej jednostek w ujęciu historycznym. Część ta zawiera w szczególności analizę wpływów, jakie procesy norymberskie oraz tworzone międzynarodowe trybunały karne wywarły na rozwój karnoprawnej, indywidualnej odpowiedzialności jednostki za zbrodnie międzynarodowe. Na drugą część artykułu składają się rozważania dotyczące pozytywnych i negatywnych aspektów wydania międzynarodowego nakazu aresztowania wobec prezydenta Sudanu Omara Al-Bashira oraz jego współpracowników Ahmada Haruna i Alego Kushayba. Zawiera ona również analizę przedstawionych im zarzutów oraz podstawy prawne ich odpowiedzialności. Ponadto została zwrócona uwaga na znaczenie immunitetów w międzynarodowym prawie karnym. W szczególności rozważana jest sytuacja indywidualnej odpowiedzialności prawnomiędzynarodowej jednostek sprawujących kierownicze stanowiska w państwie, niebędącym stroną statutu MTK, za zbrodnie międzynarodowe. W części tej określona została również relacja zachodząca pomiędzy indywidualną odpowiedzialnością jednostek a ich prawnomiędzynarodową odpowiedzialnością jako organów państwa. Trzecia część artykułu stanowi próbę odpowiedzi na nurtujące społeczność międzynarodową pytanie, dotyczące skuteczności egzekwowania prawnomiędzynarodowej odpowiedzialności jednostek. Zawarte w niej uwagi wskazują również, na przykładzie Sudanu oraz innych państw afrykańskich, na skutki prawne, ekonomiczne oraz polityczne, jakie względem ludności tych państw wywołują międzynarodowe nakazy aresztowania wydawane wobec ich przedstawicieli. This paper provides the analysis of the international legal responsibility of individuals in the context of international arrest warrants issued by the International Criminal Court against the Sudan country leaders. An attempt is made at resolving the question concerning the enforceability of the said international arrest warrants by the International Criminal Court. Moreover, the paper seeks to determine whether the legal proceedings concerning the issuing of international arrest warrants, as instituted by the Security Council and by the International Criminal Court Prosecutor (Article 13b of the ICC Statute), contribute to improving the efficiency of the International Criminal Court. It also defines the role of international immunities in shaping the international criminal law, as well as outlines the obligations binding on international agreement signatories. It further seeks to resolve the question of applying double standards by the International Criminal Court in issuing the international arrest warrants at issue, as well as present the legal, political and economic consequences of issuing international arrest warrants on the life of international communities. Finally, the article raises a question of the effectiveness of activities undertaken by the International Criminal Court in the area of international peace and security. (original abstract)
