Artykuł prezentuje aktualną sytuację postrzegania roli korporacji transnarodowych we współczesnej ochronie praw człowieka. Problematyka jest o tyle ważna, że współczesny model postrzegania praw człowieka opiera się na tak zwanym uniwersalizmie. Uniwersalizm praw człowieka opiera się na trzech podstawowych filarach: po pierwsze, podmiotowości (przysługującej każdej osobie ludzkiej z racji bycia człowiekiem); po drugie, terytorialności (nie zależnej od kręgu cywilizacyjno-kulturowego); po trzecie; czasowości (trwającej mimo ewolucji społeczeństw i narodów). I właśnie to uzasadnia szukanie wszystkich możliwych źródeł i dróg, aby dzisiejsza ochrona praw człowieka obejmowała jak najszerszą listę podmiotów zobowiązanych do jej stosowania i przestrzegania. Nie tylko klasycznie państwa, ale również i inne podmioty, które swoimi działaniami wpływają i mogą kształtować standard poszanowania praw człowieka. Międzynarodowa debata na temat powiązań korporacji transnarodowych z ochroną praw człowieka rozpoczęła i się w latach 70-tych XX wieku, jest nadal aktualna i trwa do dziś. Wpływa na to globalizacja, jako zjawisko ogólnoświatowe. Podkreśla się, iż szeroka działalność gospodarcza tych podmiotów w znaczący sposób wpływa na możliwość przestrzegania praw człowieka w wielu państwach jednocześnie, gdzie podmioty te prowadzą swoją aktywność. Zaprezentowane zostały najważniejsze aktywności państw na arenie międzynarodowej, mające na celu unormowanie w sposób prawny odpowiednich postaw korporacji transnarodowych w obszarze przestrzegania praw człowieka. Analizie poddano inicjatywy najważniejszych organizacji międzynarodowych takich jak: Organizacji Współpracy Gospodarczej i Rozwoju, Międzynarodowej Organizacji Pracy i Organizacji Narodów Zjednoczonych. Zwrócono uwagę na niekompletność i małą skuteczność tych działań objawiającą się w braku powszechnie przyjętego i prawnie wiążącego instrumentu prawa międzynarodowego, który by takie kwestie regulował. The article presents current situation of the perception of the role of transnational corporations in the protection of human rights. The issue is so important, that the contemporary model of the perception of human rights is based on the so called universality. The universalism of human rights is based on three fundamental pillars: 1) subjectivity (applicable to each person of the human by virtue of being human); 2) the territoriality (on the circle of civilization and cultural heritage); 3) time (on going despite the evolution of societies and nations). This justifies the search for all possible sources and routes, to today's protection of human rights included the broadest list of entities responsible for its application and enforcement. The international debate on the links between human rights protection launched the transnational corporations in the 70's of the 20th century. It is still valid and continues today. It affects globalization, as a worldwide phenomenon. Presented on the international scene have been the most important activity of States in order to standardise the legal relevant attitudes in the transnational corporations in the area of human rights. The most important initiatives were analysed, international organisations such as the Organisation for Economic Cooperation and Development, the International Labour Organization and the United Nations. Noted the incompleteness and a small performance of these activities. It is revealed in the absence of commonly agreed and legally binding instrument of international law, which would regulate such issues. (original abstract)
